Thermage#174; and
Syneron Medical (NASDAQ: ELOS) today announced that they have reached an
agreement, resolving lawsuits that claimed Syneron infringed certain
patents held by Thermage and that Thermage infringed a patent held by
Syneron.

Syneron subsequently filed a patent infringement counterclaim against
Thermage, alleging that Thermage infringed U.S. Patent No. 5,569,242, (the
242 patent) which Syneron had recently acquired. The counterclaim, filed
on January 10, 2005, was added to the patent litigation between Thermage
and Syneron then pending in the Northern District of California. The 242
patent covers methods for controlled contraction of collagen using
radiofrequency energy. Synerons counterclaim alleged that the methods
performed by Thermages ThermaCool(TM) product infringe the 242 patent,
and sought damages and injunctive relief for infringement by Thermage.

An unsolicited buyout offer of more than $130 million was made for the Hayward-based skin tightening company Thermage just a month after it announced its own purchase plan. Even though the name of the bidder wasnt disclosed, the $5.50 per share offer excited investors as shares of Thermage rose 44 percent, or $1.32, to $4.34. If it is approved, it would be a separate transaction from the $87.5 million deal made in July when Thermage announced it planned to buy out Mountain View-based skin resurfacing company Reliant Technologies for about $87.5 million in cash and stock.

Theres a stone-built shed in our garden. The floor is cobbled with smooth pebbles collected from the beach 150 years ago when the shed was built. Likewise, the mortar holding it together is made with coarse sand and miniature seashells. Gaps in the roof let in the wind and rain. It was a pigsty, I think. Latterly I kept ferrets in there. Now its a woodshed. The knotty tree ring I use as a chopping block is comfortable enough to sit on in a contemplative or depressed mood. A Victorian pine kitchen-dresser, painted green, on which Ive pinned all the rosettes Ive ever won at ferret shows, takes up one wall. Reds for firsts, blues for seconds, yellows for thirds, and a brown one as big as a dinner plate commemorating a golden summer Sunday afternoon when King Sulieman the Magnificent, my albino hob, won best in show.
Transforming some crumbling outhouses and a 150-year-old cottage into a brightly coloured home became an an abiding passion for one family. Patricia Ace describes the transformation from traditional to contemporary Uppermost in our minds was to develop a stimulating environment for ourselves and our two young children who were five and 15 months when we moved in. Consequently a strong theme of fun became apparent in our decor and people who visit are often surprised to discover a treasure chest of jewel-coloured rooms and contemporary style inside a very traditional white stone cottage. There is no floral chintz or Laura Ashley wallpaper, no Aga or wood-burning stove, although these things could easily be accommodated if required. The kitchen is modern but retains a country feel with coloured Shaker-style units and an antique pine dresser; we have combined these with a stainless steel oven, hob, sink and accessories to add an element of urbanity and city chic. This mixture of old and new is characteristic of our interior design; we have successfully mixed cheap and cheerful pieces from Ikea and Habitat with older pine and birdseye maple from the local auction house, Loves of Perth. Seventies floor lamps and wicker bedroom chairs sit happily next to Grannys old sewing table and Grandads bureau. It really boils down to having the confidence to experiment and throw things together, to spotting the connections between these contrasting designs and developing your individual style around them. The original floorboards in the kitchen, sanded and varnished, have proved surprisingly practical with small children trailing mud in and out of the house all day and little ones can even ride a trike or rollerblade round the spacious kitchen and living room, proving that designer looks can be child-friendly too. Our bedroom was based on a bedouin tent to begin with, but has developed into more of a deep, dark haven which my partner Fin and I now call our womb! I bought fabrics from Zum Zum Saree in Glasgow and used them to cover our wardrobes and on the ceiling, creating a red and silver loveheart drape over our chunky pine bed. The walls, carpet, ceiling and curtains are blood red which makes the space pretty dark, but on sunny days the room glows like a ruby. Its theatrical and dramatic, passionate and protective and I have slept like a log in its soporific peace, despite its strong, vibrant colour. The bathroom I initially envisaged as having a jungle theme, but it quickly developed into a garden as we discovered daisy accessories in abundance: wall sconces, towel rail, toilet-roll holder and hooks from Shaker, shower curtain, baskets, candles and pictures. We painted the entire room lime green and stencilled 18-inch daisies along the wall, adding a white trellis to the skirting boards. But the choice of leisure lawn as a carpet has become one of the most talked-about features of our home as friends and family marvel at what they call Astroturf used in a domestic setting. I still love it. It glitters in the sunlight and has proved immensely practical as it copes well with water, even the amount splashed out of the bath by our two solidly-built children re-enacting scenes from Titanic. The hall we tackled last and decided to make it a hall of fame, celebrating our lives and those of family and friends with a good dollop of humour thrown in. As a backdrop we chose three different shades of blue paint: dark, mid and light, and a warm sandy-coloured carpet. This gives a bright and breezy, beachy feel to the main thoroughfare of the house. We made it stimulating to the eye and ear with an assortment of chimes and mobiles suspended from the ceiling, most of them gifts, and covered the walls with framed holiday snaps, wedding photos of friends and snippets from their marriage services, tickets from T-in-the-Park, King Tuts and a carnival in Trinidad, photos of past houses, beloved first cars and postcards of footballers, reefers and willies - amongst other things - sent to us by friends. Visitors spend ages in the hall on the way to the bathroom, studying these diverse images. On sunny summer days it feels almost Mediterranean here in deepest Perthshire, with all the kids playing happily in the courtyard, and our home adds to that illusion with its strong, bright colour scheme and vivacious interior design, but our living room has a quieter and more neutral feel to it. Here, in the largest room of the house, we have concentrated on light and space and have transformed what initially resembled a gymnasium, with its white walls and shiny pine floor, into a natural sanctuary with driftwood from Scottish beaches, fake fur brown cow cushions, a goatskin rug and an unusual swirly floor lamp which the kids describe as a giant piece of pasta. Two strong African pieces, a carved five-foot giraffe and a large framed fabric print, both from Zimbabwe, provide a hint of the exotic and blend with the cane blinds; sprays of dried honesty, carved wooden flowers, baskets of dried cones and seashells balance out the technology of the TV, video and hi-fi. This room works best however as a reflection of the outside in, and this is due to the wall mirror which, at six-foot square, dominates the space. A housewarming present from Fins parents, this huge glass has been an amazing success with all the family. The kids adore making faces in it, dancing around in front of it and generally posing in it, I can perfect my yoga positions in it and Fin tends to pretend it isnt there, except to acknowledge its ample sexual potential! The best thing about the mirror is the way it connects the growing garden around the patio by reflecting the view through the glass doors and the amount of light it adds to an already bright and spacious room. We are moving on next month, to a Victorian villa in nearby Crieff, and are looking forward to trying some new design ideas on a somewhat larger scale. Cement use in the historic cemeteries of the French Quarter Although most concrete crypts and mausoleums are built in low-lying areas, where water could easily destroy a coffin, its not entirely true for the city of New Orleans. Basically, the majority, if not all, of the crypts and mausoleums in the cemeteries of New Orleans were built along the lines of traditional European cemeteries and to represent the architecture of a French city. In fact, many visitors to New Orleans have stated that these cemeteries do look like a miniature city-a “city of the dead”1 (Fig. 2 and 3). Most of the crypts and mausoleums in New Orleans are constructed of brick covered with a cement plaster (see Fig. 4). Even when these crypts and mausoleums need repair work done, workers use a mixture of both lime and cement. This combination does not detract from the original structure.2

The most valuable sale of Impressionist and modern art ever staged in Britain is to take place in London on Monday. Simon Shaw of Sothebys said: “London was very much eclipsed by New York during the 1990s. Now were seeing that reversed.” In terms of the quality and range of the works consigned for sale “this looks very much like a New York sale”, he said. “Although were not equal with New York, the balance is shifting very significantly. Five or six years ago we were rarely selling $10m pictures. Now were selling quite a few.” The most expensive work is Jeanne Hebuterne (Au Chapeau) by Amedeo Modigliani, expected to make up to pounds 12m. Other works include La Sortie du Bain by Edgar Degas, a pastel dating from around 1895. Paintings by Pablo Picasso include Le Peintre et son Modle, estimated at up to pounds 7m and Les Courses Auteuil, from the start of his career in 1901, estimated at up to pounds 2.5m. There are also works by Raoul Dufy, Camille Pissarro, Alfred Sisley and Gustave Caillebotte.
THE BIGGEST sale of Impressionist and modern art to be held in Britain in a decade is expected to make more than pounds 50m later this month. Four Picassos, two Renoirs, a late Monet and a Modigliani that was once owned by the Guggenheim gallery but controversially sold 10 years ago, are among the works which will be auctioned by Sothebys in London on 21 June. Melanie Clore, head of the Impressionist and modern art department at Sothebys, said many sales had one great work in them but that this sale was distinguished by a number of really good pictures.
An Impressionist Sensibility features 26 paintings by William Merritt Chase, Childe Hassam, Winslow Homer, John Singer Sargent and John Twachtman, among other internationally known artists. The Halffs, who live in San Antonio, acquired these masterpieces during the past 20 years. In addition to reflecting the Halffs keen eye for the finest artworks from this period, the collection also is noteworthy for illustrating the consistency of their vision. The paintings in the collection are linked through a shared sensibility about American cultural aspirations at the turn of the century. Pocket gophers are fossorial (burrowing) rodents–so named because they have fur-lined pouches outside the mouth, one on each side of the face. These pockets, which are capable of being fumed inside out, are used for carrying food. Pocket gophers are powerfully built in the forequarters and have a short neck; the head is fairly small and flattened. The forepaws are large-clawed and the lips close behind large incisors. This feature allows them to use their incisors for digging without getting a mouthful of dirt, a unique feature to gophers. There are over 30 species of pocket gophers in the Western Hemisphere. Pocket gophers vary in size from 5 1/2 inches in length to over 13 inches in length. Litter sizes vary from one to 10 but typically average three to four. In the northern part of their range they have one litter per year, as opposed to up to two in the southern ranges. Young gophers are dispersed above ground and are capable of swimming as well on the search for suitable habitat to begin new burrow systems. Pocket gophers feed in three ways: they feed on roots, above-ground vegetation, and they pull vegetation into their tunnel to be stored in food caches for later consumption. In the vineyard, pocket gophers girdle vines, damage roots systems (most often in new plantings), and cause multiple-irrigation problems by promoting erosion and damaging drip lines. They are solitary little beasts, vigorously maintaining and defending their tunnel system. Depending on the species and available habitat, gopher population density may vary from six to eight per acre, to up to 62 per acre. Gophers do not hibernate and only cohabitate during the breeding season The burrowing activity of one gopher produces up to 70 mounds in one month. So how do you control such an active but solitary rodent? The fact that a gopher is solitary works to your advantage. You have three basic pest management tools for gopher control: Biological control, chemical control and trapping.

As your new president, I face a challenging task when it comes to speaking to you about school finance. Let me give you my dilemma. It is the end of the school year as I write this piece and I am reflecting on the uncertain state of school finances in coming months and what these financial challenges mean for us as school system leaders. You will share my frustration that as many as half the nations students may be directly shortchanged of the education they deserve, with the remainder not immune to the impact of belt tightening. As bad as that news is, last year at this time NCSL found 36 states with budget gaps. On the other hand, NCLB and IDEA could be funded retroactively, which would help make up for last years budget shortfalls that resulted from unfunded or underfunded mandates. If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. If youre not in that sunny camp, please continue and let me share my thoughts.

Where Creativity and Capital Meet Using Untapped Collateral and Nontraditional Payment Terms Three significant requirements are needed for a client to utilize monetization financing: 1) an assignment of/or an absolute and unconditional promise to pay from an investment-grade obligor or an acceptable substitute financial instrument backing the transaction, 2) a predictable cash flow, and 3) a date-certain payment. A study conducted at a health care organization in Ireland investigated the use of cell phones and their potential for carrying bacteria that cause health care-associated infections (HAIs). (1) The sample was composed equally of physicians and nurses; 98% owned a cell phone and 70% had their cell phones available for bacterial sampling. Ninety-six percent of the cell phones were contaminated with bacteria, and 15% grew bacteria known to cause HAIs. One bacterial species was found on 38% of the telephones, two different species were found on 38% of the telephones, and three or more species grew on 20.9% of the telephones. Bacterial types isolated were coagulase-negative Staphylococcus (93%), Micrococcus species (39%), Bacillus species (20%), diptheroids (6.6%), methicillin-sensitive Staphylococcus aureus (5.7%), Streptococcus viridians (5.7%), coliforms (4.7%), MRSA (1.9%), Enterococci faecalis (0.95%), and Clostridium perfringens (0.95%). There was no significant difference in bacterial contamination between the physicians and nurses telephones. (1) Investigators at a tertiary care hospital in Israel studied cross contamination between cell phones, hands, and patients. (2) Cell phones and hands were swabbed and cultured for Acinetobacter baumannii. A significant percentage of the cell phones (ie, 41.8%) and hands (ie, 81%) were contaminated with Acinetobacter species, and cross contamination between cell phones, hands, and patients occurred.

There are three kinds of acne: mild, moderate, and severe.
Acne FulminansAcne fulminans is a rare skin disorder with multisystem involvement. The most severe presentation of acne, the condition most commonly occurs in white adolescent males.[1] Clinically, nodulocystic acneiform lesions develop on the face, torso and upper extremeties. The lesions are highly inflamed and tender, and eventually ulcerate. Systemic manifestations include fever, weight loss and musculoskeletal complaints. Leukocytosis, mild anemia and elevated erythrocyte sedimentation rate (ESR) are typical laboratory findings. Since family physicians and other primary care physicians evaluate and treat more skin conditions than do dermatologists,[2,3] it is essential that this potentially catastrophic form of acne vulgaris be generally recognized and promptly treated.
Low-dose COCs not only serve for contraception but also reduce acne, a common dermatological problem for adolescents that can leave both psychological and physical scars. Acne can be treated by reducing the effect of androgen in the body, (13) either directly (with anti-androgen) or indirectly (with estrogen). Estrogen reduces the availability of active free androgen by increasing sex hormone-binding globulin in the blood, and several randomized controlled trials have found COCs to improve acne when compared with placebos. (14) Similarly, combinations of lowdose estrogens and such progestins as cyproterone or drospirenone are effective in treating acne and providing contraception at the same time. As habits go, newspapers are reasonably cheap and fairly harmless. Like all addictions, they can lead you into peculiar and unsociable behavior. It need hardly be said that for the true paper gourmand, only the right printed pulp will do. In my case, its The Guardian, sometimes referred to by the more affected addict as The Manchester Guardian. Its a liberal, dissenting journal, originally from the northern English manufacturing town of Manchester. Now the offices are located in Clerkenwell in London, across from the Marx Library with its memorabilia of Lenin, and the gate to which John Ball led the Peasants Rebellion in the fourteenth century. In this neighborhood, not long ago, lost causes were easily forgotten in the many pubs of the area. Now they are increasingly gastropubs, with fine wines and restaurant-quality food, targeting a more conservative audience. When I was younger, just finding a copy of The Guardian was often an achievement. With its vaguely left politics and conservative returns policy (meaning that if a shop didnt sell a copy it was stuck with it), The Guardian was hard to find. This simply appealed to the collector in me. With a Labour government in its second term in Britain, The Guardian is now ubiquitous there. Even in Europe, a slimmed-down version can be found quite easily in the major cities of France, Italy, and Spain–all countries with impressive newspaper habits. From a recent trip, I can report that while the paper is everywhere in Stockholm, it is not yet available in the Arctic cities of Sweden–I did try, yes. In the United States, a collector can still find some sport. As a resident alien, my mental map of major U.S. cities is distorted by the routes required to pass by Guardian vendors. Its Situationism for the newspaper addict, an apparently random walk, concealing a personal and political purpose. In New York, for instance, the appeal of NoLita is not the ludicrously expensive fashion-victim stores but the little South Asian grocery that is a reliable Guardian source. If going to the Strand, New Yorks still-surviving secondhand bookstore, get off the subway a stop early to bit the newspaper shop on 23rd and Broadway. On St. Marks Place, theres a shop with an amusing variation. Here they print out copies of the same days paper from an online supplier onto broadsheet-size paper. I still prefer the day-old copies on newsprint, but the new version will do in a pinch. Why not? Or why not simply access the very good website? Its about the body and a certain comfort that comes from the feel and smell of a commo dity that has become an old friend, which the hunched, impersonal reading of a laptop screen cannot replicate. I grow old.

Lawyers need courage and compassion as personal virtues. But lawyers may need these virtues in ways that they had not imagined when they first entered the Bar. Statistics about lawyers are alarming. I have read that 40-50 percent of disciplinary cases involve lawyers who are suffering from an impairment, usually an addiction to alcohol or drugs. I have read that lawyers are twice as likely as other Americans to have an addiction, depression, suicidal tendencies, or stress anxiety. To be more concrete, I have read that 10 percent of Americans suffer from an addictive, emotional, or mental impairment. By contrast, these same sources estimate that 20-25 percent of lawyers suffer from an impairment. If this is true, it means that in Oklahoma at least 2,000 lawyers are practicing who are impaired. Two thousand lawyers who likely do not realize that they need to be courageous and compassionate toward themselves. Lawyers need courage to say, “I am an alcoholic,” or “I am addicted to drugs.” Lawyers need courage to say, “I am emotionally exhausted by my divorce,” or “I am overwhelmed with grief at the death of my child,” or “I am debilitated by too much work.” Once lawyers are courageous with themselves, they can be compassionate to themselves by seeking assistance to address these burdens. But not all lawyers individually will either have the insight or the courage to face the fact that they are suffering from an impairment. In those instances, their fellow lawyers must have the courage to speak the truth to the impaired lawyer. Fellow lawyers must not turn away from the impaired lawyer in the ill-advised hope that all will be OK somehow. Fellow lawyers show compassion for an impaired lawyer not by ignoring the lawyers impairment but by helping that lawyer to get needed assistance. Moreover, by acting with courage to assist an impaired lawyer, fellow lawyers can often prevent serious harms from occurring either to the impaired lawyer or to the impaired lawyers clients. Once harm occurs to clients, fellow lawyers have the obligation to report the impaired lawyer to disciplinary authorities for misconduct. Where can a lawyer with an impairment, or fellow lawyers desiring to assist, go for help? Since 1985, the Oklahoma Bar Association has supported the Lawyers-Helping-Lawyers Committee. For 12 years, the volunteer members of this committee have provided confidential, immediate responses to those who call for help. Volunteer members arrange a meeting to discuss the situation and to offer suggestions for further treatment — be it counseling, admission to a treatment center, or joining a 12-step program. Volunteer members will serve as a sponsor to meet with the impaired lawyer as often as necessary to get the lawyer on the road to recovery. Lawyers-Helping-Lawyers has the goal of recovery, not discipline. Beginning in January, the Oklahoma Bar Association committed $18,000 to match $18,000 provided by the Oklahoma Attorneys Mutual Insurance Co. to hire a part-time director for the committee. As described by the Lawyers-Helping Lawyers Committee, the director will develop treatment plans, conduct counseling sessions, make lawyer evaluations and referrals, maintain a 24-hour hotline, coordinate the activities of the committee volunteers and develop educational programs for the Bar about impairment. In addition, the director will identify professionals from other disciplines who have the skills and the desire to work with lawyers suffering from an impairment. This year is the first year that Lawyers-Helping-Lawyers has had a staff member devoted to its tasks. While the arrangement at present is only for a one-year trial period, Lawyers-Helping-Lawyers is hopeful that the trial period will convincingly show the need for a full-time director on a permanent basis beginning in 1999. Lawyers-Helping-Lawyers has acted with courage and compassion to face an issue that has not received the attention that its seriousness deserves. Lawyers are suffering; clients are at risk; the profession bears the stigma of attorneys who commit misconduct while impaired. For ourselves, our clients, and the profession, we, the organized Bar, need to say, “We, my brother and sister lawyers, are human. We are impaired. Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. FOR THE uninitiated, medical and health insurance is a relatively new class of insurance in Malaysia compared to motor, fire or personal accident insurance. A lot has been written about it, but there continues to be confusion over what health insurance really is.

Computers and Accounting In manual accounting systems, all entries are handwritten and all records are prepared by hand, although admittedly with the aid of a calculator. Initial transactions such as sales and payables are recorded in specialized journals and then posted manually to the subsidiary journals and/or to the appropriate general ledger accounts. PLUS workshop examines hard market for legal liability, jump in law suits Lawyers malpractice insurance rates are on the rise, primarily due to a prolonged soft market that had to flatten out sooner or later, and partly due to a legal system that is growing more complex every day.
Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. CancerCancer is, in general, more common in industrialized nations, but there has been a growth in cancer rates in developing countries, particularly as these nations adopt the diet and lifestyle habits of industrialized countries. Over one million people in the United States get cancer each year. Anyone can get cancer at any age; however, about 80 percent of all cancers occur in people over the age of fifty-five.
C ANCER The scope of the problem in the United States is large. Some 1.2 million people were diagnosed with potentially fatal cancer in the year 2000. Of these, 59 percent were expected to live for at least five years (in some, the cancer may be continuously present for more than five years) with or without evidence of cancer. People of all ages, from birth to advanced age, can manifest cancer, making it the second-leading cause of death in the United States. In children cancer is unusual, but it has consistently been the leading cause of death from disease. As mortality rates from cardiovascular disease decline, the proportion of cancer deaths increases.
